1. Acceptance of Terms

By downloading, installing, or using China Restaurant POS ("App"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the App.

These Terms constitute a legally binding agreement between you and China Restaurant POS regarding your use of the App.

2. Description of Service

China Restaurant POS is a point-of-sale application designed for buffet restaurants. The App provides:

  • Order entry and receipt generation
  • Receipt printing to thermal printers and AirPrint
  • Sales tracking and analytics
  • Staff management and role-based access
  • Offline functionality with data synchronization
  • Multi-language support

3. Account Registration

To use certain features of the App, you must create an account. You agree to:

  • Provide accurate, current, and complete information during registration
  • Maintain and promptly update your account information
  • Keep your password secure and confidential
  • Accept responsibility for all activities under your account
  • Notify us immediately of any unauthorized use of your account

4. Acceptable Use

You agree to use the App only for lawful purposes. You shall not:

  • Use the App for any illegal or unauthorized purpose
  • Attempt to gain unauthorized access to the App or its systems
  • Interfere with or disrupt the App's functionality
  • Reverse engineer, decompile, or disassemble the App
  • Remove or alter any proprietary notices or labels
  • Use the App to transmit malware or harmful code
  • Share your account credentials with unauthorized users

5. Subscription and Payments

Free Tier

The App offers a free tier with limited features. No payment is required for basic functionality.

Professional Subscription

Premium features require a paid subscription. Subscriptions are billed through the Apple App Store and are subject to Apple's terms and conditions.

Subscription terms:

  • Subscriptions automatically renew unless cancelled
  • You can cancel anytime through your App Store settings
  • No refunds for partial subscription periods
  • Price changes will be notified in advance

6. Data and Content

You retain ownership of all data you enter into the App ("Your Data"). By using the App, you grant us a limited license to:

  • Store and process Your Data to provide the service
  • Create backups for data protection purposes
  • Generate anonymized, aggregated analytics

You are responsible for maintaining backups of Your Data. We recommend regularly exporting your data.

7. Intellectual Property

The App, including its design, features, content, and underlying technology, is protected by intellectual property laws. You acknowledge that:

  • We retain all rights, title, and interest in the App
  • These Terms do not grant you any intellectual property rights
  • The App name, logo, and branding are our trademarks

8. Disclaimer of Warranties

THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. TO THE FULLEST EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES INCLUDING:

  • Merchantability and fitness for a particular purpose
  • Non-infringement of third-party rights
  • Uninterrupted or error-free operation
  • Accuracy or reliability of any information

9. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING:

  • Loss of profits, revenue, or data
  • Business interruption
  • Cost of substitute services
  • Any other intangible losses

Our total liability shall not exceed the amount you paid us in the twelve (12) months preceding the claim.

10. Indemnification

You agree to indemnify and hold harmless China Restaurant POS, its officers, directors, employees, and agents from any claims, damages, losses, liabilities, and expenses arising from:

  • Your use of the App
  • Your violation of these Terms
  • Your violation of any third-party rights

11. Termination

We may terminate or suspend your access to the App at any time, with or without cause, with or without notice. Upon termination:

  • Your right to use the App will immediately cease
  • You may request export of Your Data within 30 days
  • We may delete Your Data after 30 days
  • Provisions that should survive termination will remain in effect

12. Changes to Terms

We reserve the right to modify these Terms at any time. We will notify you of material changes by:

  • Posting updated Terms in the App
  • Updating the "Last Updated" date
  • Sending notice through the App or email

Your continued use of the App after changes constitutes acceptance of the modified Terms.

13. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the United States, without regard to its conflict of law provisions.

14. Dispute Resolution

Any disputes arising from these Terms or your use of the App shall be resolved through:

  1. Good faith negotiation between the parties
  2. Mediation if negotiation fails
  3. Binding arbitration as a final resort
